1. Acceptance of Terms

By accessing or using WebEnture's services, including our website optimization platform, AI agents, and related tools (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services. These terms constitute a legally binding agreement between you and WebEnture.

2. Description of Services

WebEnture provides website optimization and analysis services using artificial intelligence technology. Our Services include:

• AI-powered website analysis and optimization recommendations
• Multiple specialist AI agents for different aspects of website improvement
• Performance monitoring and reporting tools
• Subscription-based access to our platform and AI agents

3. User Accounts

To use certain features of our Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

• Provide accurate and complete information
• Immediately notify us of any unauthorized use of your account
• Ensure you exit from your account at the end of each session

4. User Content and Permissions

When you provide website URLs, content, or other information for analysis, you grant us permission to use this information to provide our optimization services. You represent and warrant that you have all necessary rights to provide this information and that you own or have permission to analyze the websites you submit.

Important: Only submit websites that you own or have explicit permission to analyze. Do not submit competitor websites or any content that you do not have rights to.

5. Intellectual Property

The analysis reports and recommendations generated through our Services are a combination of your website data and our proprietary AI technology. While you own the rights to implement the recommendations on your websites, WebEnture retains ownership of:

• Our AI technology and algorithms
• The analysis frameworks and methodologies
• The platform interface and user experience
• All trademarks, logos, and brand elements

You may use the analysis reports and recommendations for your business purposes. However, you may not redistribute, resell, or share our proprietary analysis methods or platform access with third parties without our written permission.

6. Subscriptions and Payments

Our services are offered through monthly subscription plans with different AI agent usage limits. Subscription terms, pricing, and payment methods are specified at the time of purchase. By subscribing to our Services, you authorize us to charge the applicable fees to your designated payment method.

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings. Usage limits reset monthly and unused AI agent uses do not carry over to the next billing period.

7. Free Trial & Refund Policy

Free trial: New users may activate a 7-day Pro trial at no charge — no credit card required. After 7 days, the account automatically reverts to the free plan. We never auto-charge at the end of a trial. The trial may only be used once per account.

14-day satisfaction guarantee: If you are not satisfied within 14 days of your first payment on any paid plan, email support@webenture.com for a full refund — no questions asked.

After the 14-day guarantee period, all paid subscription fees are billed in advance and are non-refundable, except as described below:

• Service outages: If WebEnture experiences a verified outage exceeding 24 consecutive hours, you may request a pro-rata credit for the affected period. Credits are applied to the next billing cycle and are not redeemable as cash.
• Cancellations: You may cancel at any time. Your subscription remains active until the end of the current billing period. No partial-month refunds are issued on cancellation.
• Termination for cause: If your account is terminated for violation of these Terms, no refund is owed.

To request a billing credit, email support@webenture.com with your registered email address and details. We will respond within 5 business days.

8. Prohibited Uses

You agree not to use our Services to:

• Create, transmit, or store content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity or misrepresent your affiliation with a person or entity
• Engage in any activity that could damage, disable, or impair our Services
• Attempt to gain unauthorized access to our systems or user accounts

9. Privacy

Our Privacy Policy explains how we collect, use, and protect your information. By using our Services, you consent to the data practices described in this policy.

10. Disclaimers and Limitations of Liability

Our Services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that our Services will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, WebEnture shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our Services.

11. Indemnification

You agree to indemnify and hold harmless WebEnture, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from your use of our Services or violation of these Terms.

12. Modifications to Terms

We may modify these Terms at any time by posting the revised terms on our website. Your continued use of our Services after such changes constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ghaziabad, Uttar Pradesh, India.

14. AI-Generated Content

Our platform uses artificial intelligence (including third-party AI models) to generate website analysis, scores, recommendations, and other content. You acknowledge that:

• AI-generated results are automated and may contain errors, omissions, or inaccuracies.
• Analysis results do not constitute professional advice (legal, financial, technical, or otherwise).
• You are solely responsible for verifying recommendations before implementing them.
• WebEnture is not liable for any decisions made based on AI-generated output.
• AI recommendations reflect conditions at the time of analysis and may become outdated.

15. Account Termination

We reserve the right to suspend or permanently terminate your account, with or without notice, if you:

• Violate these Terms or our Acceptable Use Policy.
• Use the Services for illegal, abusive, or fraudulent purposes.
• Attempt to reverse-engineer, scrape, or abuse our APIs or AI systems.
• Fail to pay applicable subscription fees.

Upon termination, your right to access the Services ceases immediately. You may request deletion of your data in accordance with our Privacy Policy. Paid subscription fees are non-refundable upon termination for cause. You may terminate your account at any time via Account Settings.
